1. Ms. Aishwarya Thapliyal, learned counsel for the petitioners.
2. Mr. R.K. Joshi, learned Brief Holder for the State of Uttarakhand.
3. Petitioners have approached this Court for protection. According to them, they were in love and they got married, as per Hindu rites & customs on 11.02.2025 at Kashipur, District Udham Singh Nagar; thereafter, they got their marriage registered with the Sub- Registrar, Registration of Marriage, Kashipur, District Udham Singh Nagar on
15.02.2025.
4. Both petitioners are personally present before the Court who are duly identified by their learned counsel Ms. Aishwarya Thapliyal. We have also interacted with them.
5. According to petitioner no. 2, he is employed as Branch Manager in a Non- Banking Finance Company known as
“M/s Ummeed Housing Finance Kashipur”. Petitioner no. 1 stated that she has done B.Ed., but not employed anywhere.
6. Learned State Counsel submits that since both the petitioners are major and they have decided to live together as husband and wife, hence, in view of the law laid down by Hon’ble Apex Court in
2025:UHC:1411-DB the case of Lata Singh Vs. State of U.P. and Another; 2006 (5) SCC 475, we are inclined to grant protection to the petitioners.
7. Having regard to the facts and circumstances of the case, the writ petition is disposed of by permitting the petitioners to approach Station House Officer, P.S. Kashipur, District Udham Singh Nagar for protection and if petitioners make formal application for protection, SHO concerned shall take decision thereupon, as per law, within ten days. Such application shall be made by the petitioners on or before
04.03.2025. Till decision on the application, to be submitted by the petitioners, they shall be provided protection.
8. Let a certified copy of this order be supplied to learned counsel for the petitioners, today itself, as per rules.
