The instant contempt petition has been filed under Article 215 of the Constitution of India read with Section 11 & 12 of the Contempt of Courts Act, 1971 for non-compliance of the order dated 06.01.2015 passed in SA No.126/2009 and order dated 28.04.2023 passed in CR No.31/2021. 3. Learned counsel for the applicant submits that despite decree granted in favour of the applicant in first appeal bearing FA No.25-A/2008 and dismissal of second appeal bearing SA No.126/2009 filed by the respondent, he is not complying with the said decree, therefore, contempt proceeding may be 2 initiated against respondent. 4. When specific question was posed to the counsel for the applicant about the execution of decree then, he submits that execution of decree is already pending before the concerned trial Court. 5. Having considered the aforesaid facts, no case of contempt is made out, as such I do not find any reason to proceed further in the matter, initiating contempt proceeding against the respondent. 6.
