3. The Petitioners are seeking pre-arrest bail in connection with 2(c)CC Case No.62 of 2025 pending on the file of learned S.D.J.M., Balasore arising out of RPF Post Rupsa Case No.3 of 2025 for commission of offences punishable under Section 3-a of RPUP Act. 4. It is submitted by the learned counsel for the Petitioners that taking into account the nature of allegations, the Petitioners ought not to be subjected to custodial interrogation. 5. Such submission is opposed by Mr. S. Panda, learned CGC as well as Mr. K. Nayak, learned Senior Panel Counsel for the Union of India. 6. It is submitted by Mr. S. Panda, learned CGC as well as Mr. K. Nayak, learned Senior Panel Counsel for the Union of India that both the Petitioners in active connivance have committed the offence. 7. It is brought to the notice of this Court that the Petitioners in ABLAPL No.14680 of 2025 were working in the Railways as Inspector in RPF. 8. Learned CGC, Mr. Panda submits that the Petitioner in ABLAPL No.14676 of 2025 has criminal antecedent having been cited as an accused in Baliapal P.S. Case No.119 of 2024 U/s-392 of IPC. 9. Considering the nature of allegations, the role ascribed to the Petitioners and the property in question being of the Railways, this Court is not
inclined to entertain the application for pre-arrest bail. However, it is directed that Petitioners may surrender before the learned S.D.J.M., Balasore in connection with the aforementioned case within one month from today. In the event of their surrender and motion for bail, the same be considered by the learned S.D.J.M., Balasore on merits, in the first hour of the day. In the event of rejection of the prayer for bail by the learned S.D.J.M., Balasore, the Petitioners are at liberty to move the higher forum for bail in the second hour on the same day. 10.
On being so moved, the higher forum is requested to make an endeavor to dispose of the bail application of the Petitioners on the same day. The case diary shall be made available to the concerned courts to facilitate disposal of the bail application of the Petitioners and learned S.D.J.M., Balasore is called upon to transmit the case record to the higher forum at the earliest in the event of rejection of such bail application. 11. Accordingly, the ABLAPLs stand disposed of. U.C.C. as per rules. (V. NARASINGH)
