On the prayer of the learned advocate appearing for the petitioner, leave is granted to the learned advocate-on-record of the petitioner to add the ADM(G), Coochbehar as a party-respondent in this writ petition. Since the State is represented by the learned AGP, there would not be any necessity to serve afresh upon the added respondent. However, the learned advocate- on-record of the petitioner shall be obliged to supply a copy of the amended cause-title
2 of the writ petition to the learned advocate appearing for the State forthwith. Affidavit-of-service filed in Court today be kept with the record. The immediate grievance of the petitioner is that the application under Section 14 of the SARFAESI Act, 2002 dated August 26, 2025 submitted before the District Magistrate, Coochbehar, is yet to be disposed of. The petitioner has sought for a direction upon the District Magistrate to dispose of the said application expeditiously. When this matter is taken up for hearing, Mr. Paul, learned advocate appearing for the petitioner submits that July 20, 2026, i.e., today, has been fixed for hearing before the ADM (G), Coochbehar. On instruction, Mr. Paul further submits that the petitioner has appeared before the ADM(G), Coochbehar today, i.e., July 20,
2026. Heard the learned advocate appearing for the State.
3 Without entering into the merits of the claim made by the petitioner in the application filed under Section 14 of the SARFAESI Act, 2002, this writ petition stands disposed of by directing the ADM (G), Coochbehar to dispose of the application under Section 14 of the SARFAESI Act, 2002 dated August 26, 2025 being Case No. 29/25 by passing a reasoned order in accordance with law keeping in mind the statutory time limit and communicate the same to the petitioner immediately thereafter. With the above observations and directions this writ petition stands disposed of.
