Sri Satish Sharma, learned counsel for the applicant has filed rejoinder affidavit today in the Court. The same is taken on record. 2. The present bail application has been moved by the applicant-accused Sonu Alias Bhupai Vishwakarma for the offence punishable under Sections 2/3(1) U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986 in Case Crime No.469 of 2022, Police Station-Koraon, District-Prayagraj. 3. Sri Satish Sharma and Sri Dipanshu Kushwaha, learned advocates, appear for the applicant and submits that the accused applicant has been falsely implicated in the present case by the police. All the cases are of same nature of theft and recovery opened by the police on arresting the accused in absence of independent witnesses. There are three base cases shown in the gang chart in which, the accused is on bail. The criminal history of 11 cases is also shown against the accused. In ten cases, the accused applicant is on bail and one case is not against the accused. The accused applicant is in jail since January, 2025. 4. Per contra, learned A.G.A. for the State has opposed the bail application but could not dispute the aforesaid facts. 5. This Court has taken into consideration the rival submissions made by the parties and perused the record. 6. The perusal of the record prima facie reveals that the accused applicant is on bail in all the cases detailed in the gang chart. He is in jail since January, 2025. 7. Without touching the merit of the case, this bail application is allowed. 8. Let the accused applicant be enlarged on bail subject to furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned.
