P N MURTHY Counsel for the Respondent: 1. 3 (RNT,J C.R.P.No.2276 of 2025) The Court made the following: ORDER : This Civil Revision Petition, filed under Article 227 of the Constitution of India, has been preferred by the petitioner/husband, seeking a direction to the learned trial Court to complete the trial in F.C.O.P.No.305 of 2024 expeditiously, pending before the learned XIV Additional District & Sessions Judge, Vijayawada. 2. Heard Sri P.N.Murthy, learned counsel for the petitioner/husband, and perused the material available on record. 3. The petitioner is the husband of the respondent/wife and filed Divorce O.P.No.111 of 2022, seeking divorce under Section 10(1)(x) of the Indian Divorce Act, 1869, on the file of the Family Court/VII Additional District Judge, West Godavari, Eluru. Subsequently, the said O.P. was transferred to the XIV Additional District & Sessions Judge, Vijayawada, presently in NTR District, and renumbered as F.C.O.P.No.305 of 2024. 4. Learned counsel for the petitioner submits that the petitioner’s chief-examination was completed in January, 2025, and since then, the matter has been repeatedly listed for the cross-examination of P.W.1. He has filed copies of docket orders dated 24.02.2025, 24.03.2025, 02.04.2025, 22.04.2025, 04.06.2025, and 07.08.2025, to 4 (RNT,J C.R.P.No.2276 of 2025) demonstrate that the matter is being adjourned repeatedly, as the respondent/wife is not proceeding with cross-examination. He further submits that on 21.08.2025, the matter was adjourned to 10.09.2025 for the same purpose. According to the petitioner, such conduct amounts to deliberate delay in the disposal of the divorce petition, which concerns the valuable lives of the parties involved. 5. Having considered the submissions and perused the docket orders, this Court is of the view that a direction deserves to be issued for the expeditious disposal of the matter. 6. The Civil Revision Petition is disposed of, with a direction to the learned XIV Additional District & Sessions Judge, Vijayawada, to conclude the trial and decide F.C.O.P.No.305 of 2024 at the earliest, without undue delay. In the event of any adjournment being granted, the reason for the same shall be recorded in writing. The matter shall be considered and decided in accordance with law, after affording due opportunity of hearing to the respondent. It is clarified that this Court is not expressing any opinion or observation on the merits of the matter. The Court’s direction is limited solely to the expeditious disposal of the pending proceedings in accordance with law.
