First bail application had been dismissed on merits by this Court vide order dated 08.04.2025, passed in MCRC- 2204 of 2025.
2.
Learned counsel for the applicant would submit that there is delay in conclusion of the trial. Till date, only five witnesses have been examined. 3. On the other hand, learned State counsel opposed the bail application.
4. Heard learned counsel for the parties and perused the documents annexed with the application.
5. On perusal of documents, which are the deposition sheets of witnesses PW-1 and PW2, it transpires that the witnesses have already been examined on 13.02.2025 when the order has been passed on 08.04.2025, in MCRC-2204 of 2025. Thereafter, the applicant has not filed either any order sheet, or any deposition sheet of the witnesses to show that there is delay in trial, or the witnesses are not turning up for their evidence.
6. In view of the above, I do not find any change of circumstance to admit this second bail application. Accordingly, it is dismissed at the motion stage. Sd/- (Ravindra Kumar Agrawal) JUDGE padma
