IN THE HIGH COURT OF JHARKHAND AT RANCHI W.P.(S) No. 398 of 2025 Rajendra Prasad Mandal, son of late Vasudeo Mandal, residing at Plot No. 85 A Phase-I, Ashiyana Nagar, Phulwari P.O and P.S Rajivnagar, District- Patna, Bihar. …... Petitioners. VERSUS
1. The State of Jharkhand, through the Principal Secretary, Road Construction Department, Govt. of Jharkhand, Project Building, Dhurwa, Ranchi.
2. The Principal Secretary Finance Department, Govt. of Jharkhand, Projecting Building,Dhurwa, Ranchi. …. Respondents. ------ CORAM :
SRI ANANDA SEN, J. ------ For the petitioner(s): Mr. Nagendra Tiwari, Advocate. For State Mr. Mr. Ankit Kumar, AC to SC-I. ------ 3/28.01.2025: In this writ petition, the petitioner has prayed for retrospective promotion to the post of Superintending Engineer. He prays that he should be given promotion with effect from 10.12.2002. It is the case of the petitioner that he was acting as a Superintending Engineer from that date and his actual date of promotion should be made effective from the aforesaid date. Thus, the petitioner is praying for retrospective promotion and consequential benefits. The Hon'ble Supreme Court in the case of Government of West Bengal and Others Vs. Dr. Amal Satpathi and Ors. reported in 2024 SCC OnLine SC 3512 has recently held that there cannot be retrospective promotion. In the aforesaid judgment, it has also been held that after superannuation, there cannot be any promotion. Admittedly, the petitioner has superannuated. In that view, I am not inclined to entertain this writ petition. Accordingly, the same is dismissed.
