JUSTICE SUDESH BANSAL Order 25/09/2025 1. By means of filing the instant Criminal Misc. Petition under Section 482 of Cr.P.C. a prayer has been made to quash FIR No. 901/2019, registered at Police Station Jhotwara, Jaipur City (West) for offences under Sections 420, 467, 468, 471 and 384 of IPC so also the order dated 02.07.2021 passed by Additional Chief Metropolitan Magistrate No.3, Jaipur Metropolitan-I allowing to return file to Investigating Officer for further investigation in the impugned FIR. 2. At the outset, it has been pointed by learned Public Prosecutor that in furtherance to the order dated 02.07.2021, further investigation was made in the impugned FIR and charge sheet for offence under Section 384 IPC has been filed against accused petitioner way back on 29.07.2022. It has been further pointed out that the petitioner is a habitual offender and has been booked in as many as 21 criminal cases, including the impugned FIR. List of criminal cases wherein the petitioner was booked, has been placed on record along with factual report. 4. Counsel for the petitioner, in view of above, seeks permission to withdraw this petition with liberty to take all legal and valid objections by petitioner before the trial Court, at the stage of framing charge, if charge has not been framed till date. 5. Without expressing any opinion on the merits of the case and in view of prayer of petitioner, the instant petition is dismissed as withdrawn with liberty as prayed for. 6.
