Heard the parties. The petitioner has been made accused in connection with Adityapur P.S. Case No.317 of 2024, for the offences registered under Sections 109, 3(5) of the B.N.S., 2023 and Section 27 of the Arms Act, pending in the court of learned Chief Judicial Magistrate, Seraikella. On 27.08.2024, accused Takla is alleged to have fired upon the informant causing injury. It appears that the petitioner was also present with the accused Takla at the time of occurrence.
Learned counsel for the petitioner submitted that there is no allegation of firing upon the petitioner. Learned A.P.P. has opposed the prayer for bail, but does not dispute the aforesaid facts. In view of the submissions made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Seraikella, in connection with Adityapur P.S. Case No.317 of 2024.
