22.09.2025 Item No. 3 Crt.No.02 b.r. CPAN 1191 of 2025 In WPA 13868 of 2024 Md. Elius Hossain & Ors. -vs- Dushyant Nariala, The Principal Secretary, Government of West Bengal & Ors. Mr. Amit Kumar Pan Ms. Tanusri Santra …. For the petitioners. Affidavit of service filed in Court today, is taken on record. Affidavit of service shows that the alleged contemnor nos. 1 to 5 have duly been served with notice of the pendency of this contempt application. Still neither the alleged contemnors are present, nor are they represented. On the prayer of Mr. Amit Kumar Pan, learned advocate appearing for the petitioners, the alleged contemnor no.6 stands expunged from the array of contemnors in this proceeding. This contempt proceeding CPAN 1191 of 2025 stands dropped and closed against the alleged contemnor no.6. No order in this contempt proceeding, hence forth, shall have any effect on the alleged contemnor no.6. It shows that the direction of this Court dated November 8, 2024 has not yet been complied neither any step has been taken towards such compliance. 2 For the ends of justice and considering the legal consequence of and punishment for a contempt proceeding one last opportunity is granted to the alleged contemnor nos. 1 to 5 for complete compliance of the order in the meantime and to file a compliance report on the next day. It is made clear that in the event of non-compliance, this Court may proceed for issuance of Rule in the matter on the next day with all its consequences. The matter shall appear under the heading “Contempt Application” on December 12, 2025. The petitioners shall serve a copy of today’s order upon all the alleged contemnor nos. 1 to 5 and 6 and shall file an affidavit of service when the matter shall be taken up next. (Aniruddha Roy, J.)
