Petitioner is aggrieved by the alleged excesses at the behest of the private respondent and as such approached the police authorities. Petitioner is now aggrieved that he is unable to raise the boundary wall as there has been interference by others. State has submitted a report. Report reflects that police authorities at the relevant point of time drew up proceedings under section 107/116 of the Cr.P.C. Learned advocate for the Memari Municipality submits that the Municipality has constructed a pump house at its own land which is 2 a cause of annoyance for the petitioner and as such the Municipality has been roped in the writ petition. Having considered that the main grievance of the petitioner now is relating to boundary wall construction, I am of the view that petitioner would address such issues before the appropriate forum as police authorities are not supposed to entertain such disputes. In view of the passage of time which has passed since the information was furnished to the police authorities, if the petitioner is faced with inconveniences petitioner will file a fresh representation. Police authorities would assess and ascertain regarding the genuinity of the accusations and thereafter take steps in accordance with law. With the aforesaid observations WPA 16269 of 2024 is disposed of. Report submitted be kept with the record.
