1. Heard learned counsel for the petitioner.
2. The present transfer petition has been filed under Section 447 of Bharatiya Nagarik Suraksha Sanhita, 2023, for transfer of Sessions Trial No.116 of 2023 (arising out of R.I.T. P.S. Case No.35 of 2021, corresponding to G.R. No.116 of 2023) from the Court of learned Additional Sessions Judge-I, Seraikella to the Court of learned Sessions Judge, Jamshedpur, East Singhbhum.
3. It appears that the wife has lodged a criminal case in which she has been issued summon for giving her evidence.
4. It has been submitted by the learned counsel for the petitioner that she has no place to reside in Seraikella and as such she wants her evidence should be taken in the first half.
5. In view of above submission, the present transfer petition is hereby disposed of giving direction to the trial court where the session trial case is pending, that the evidence of the petitioner/wife shall be taken in the first half.
