Prayer in this petition, filed under Section 439 of Cr.P.C., is for grant of regular bail to the petitioner in FIR No. 65 dated 26.11.2021, registered under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘NDPS Act’) at Police Station GRP Bathinda, District Bathinda. 2. Brief facts of the case relevant for the disposal of the present petition are that on 26.11.2021, the petitioner and co-accused Parvinder Kumar @ Sunny were apprehended by a police party and recovery of 1800 tablets of Tramadol HCL and 2880 tablets of Alprazolam was effected from them. Since they could not produce any valid license or permit to keep in their possession the recovered drugs, they were formally arrested at the spot. After completion of necessary investigation and usual formalities, challan was presented in the Court. During the course of trial, the petitioner moved an application before the learned trial Court for grant of regular bail, which was dismissed, vide order dated 28.02.2022. Thereafter, he has filed the present petition seeking grant of MOHAMMAD WASEEM ANSARI 2025.09.05 10:45 I attest to the accuracy and integrity of this document CRM-M-14539-2022 (O&M) -2- regular bail and vide order dated 11.09.2023, he was granted concession of interim bail, which is still continuing. 3. At the very outset, learned State counsel has informed the Court that the trial is almost complete as all the prosecution witnesses have since been examined. It is further submitted that the petitioner was granted concession of interim bail only on the grounds of delay in trial and since the same is now complete, he is required to surrender before the learned trial Court so that the case could be finally disposed of. 4. Learned counsel for the petitioner could not dispute the factual assertions. 5. After hearing learned counsel for the parties and considering the fact that all the prosecution witnesses have since been examined, the present petition is dismissed. The order dated 11.09.2023, granting interim bail to the petitioner, is recalled. The petitioner is directed to surrender before the learned trial Court within a period of seven days from today. 6.
