JUSTICE RAJESH SHANKAR ----- For the Petitioner : Mr. Lukesh Kumar, Advocate For the Respondent-State : Mr. Ranjan Kumar, AC to Sr. SC-I For the Respondent No. 4 : Mr. Ranjan Prasad Sinha, Advocate ----- 03/28.07.2025 The present writ petition has been filed for issuance of direction upon the respondent no. 2 – the Deputy Commissioner, Koderma to allow the petitioner to build a small bridge over the drain adjacent to Koderma-Jainagar Road so that it can be used as public road to enter the petitioner’s land situated under Khata No. 68, Plot No. 1858, Mouza-Koderma, Thana No. 333, measuring an area of 13 decimals within Koderma district where his building is being constructed. Further prayer has been made for issuance of direction upon the respondent no. 4 to remove the encroachment over Gair Mazarua land and build a covered drain over the same adjacent to Koderma-Jainagar Road which is connected to the petitioner’s land and others so that it can be used as public road. 2. Having heard learned counsel for the parties and considering the nature of prayer made in the writ petition, without entering into the merit of the case, the petitioner is given liberty to prefer a fresh representation on the present issue before the respondent no. 2. On receipt of the said representation, the 2025:JHHC:20739 2 respondent no. 2, after providing an opportunity of hearing to the petitioner, shall take an appropriate informed decision within 12 weeks from the date of filing of the representation. 3.
