The present application under Section 528 of Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed to quash the order dated 5.2.2025 passed by Additional Principal Judge, Family Court, Kanpur Dehat in Recall/Restoration Application No. 1304 of 2023, arising out of an application under Section 126(2), Cr.P.C., whereby an application to recall the order dated 1.6.2023 passed in Maintenance Case No. 600 of 2022, arising out of an application under Section 125, Cr.P.C. has been dismissed. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file appropriate application/proceedings before the court of competent jurisdiction. The instant application is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction.
