This contempt proceeding is initiated by the complainant for willful disobedience of the order passed by the learned single Judge in W.P.No.52713/2017 (LA-RES) dated 22.06.2021 vide Annexure-A.

Learned counsel Sri M.Krishnappa for the complainant is present before the Court physically inclusive of learned AGA for Accused Nos.1 to 3.
3. Learned CGSC Sri M.N.Kumar for Accused Nos.4 and 5 is present before the Court physically. He has filed a memo wherein it is stated that against the order passed by the learned single Judge in W.P.No.52713/2017 dated 22.06.2021, an appeal has been preferred in W.A.No.600/2024 and the same is pending consideration. A co-ordinate Bench of this Court has passed the following

Mr.Kumar M.N. states that, a copy of the early hearing application has been served on the
learned counsel for respondent No.1. Hence, the objection is overruled.
This matter has been listed in view of the memo moved by the learned counsel for the appellant for the listing of an early hearing application.
The submission of Mr.Kumar M.N. learned counsel for the appellants is primarily that, the contempt petition has been filed by respondent No.1, which is listed on 02.04.2025.
Learned counsel for respondent No.1 states that, respondent No.1 shall not press the contempt petition, till the next date of hearing.
The submission is taken on record.

4. A copy of the order passed in the writ appeal is produced for the purpose of reference. Keeping in view the submission made by learned CGSC for Accused Nos.4 and 5 and that the writ appeal is pending consideration against the order passed by the learned single Judge, at this stage,

it does not arise for consideration of the present contempt proceeding. Consequently, the contempt proceeding is hereby dropped. However, liberty as sought for by the counsel for the complainant is granted in accordance with law.
