2 direct the respondent-authorities for payment against the actual area of the land was taken possession by the respondent no. 6. (ii)That this Hon’ble Court may kindly be pleased to direct the respondent-authorities to consider and decide the representation within stipulated time. (iii) Any other relief which may be suitable in the facts and circumstances of the case, may also be granted.

Learned counsel for the petitioner submits that the petitioner is the joint owner of land bearing Khasra No. 276/1 & 276/3 total area 11 & 10 acre respectively situated at village Rogda, Tahsil Akaltara District Janjgir Champa (C.G.), and portion of aforesaid land in Khara No. 276/1 area 6 acre and Khasra No. 276/3 area 5 acre has been acquired in the year 2010-11 for the purpose of Industrial Development Project. After the acquisition process, the land has been transferred to the private respondent No. 6 and the respondent No. 6 encroach the some extra land of the petitioner at the time of constructing boundary wall. The petitioner has made several representation for proper demarcation and payment of compensation but till date the same has not been considered, therefore he prays for a direction to the concerned authorities to decide his representation and compensation be paid to the petitioner by the respondent authority.

Learned State Counsel submits that in view of the limited prayer made by the learned counsel for petitioner seeking direction to respondent-authorities to consider the claim towards proper compensation and demarcation, he is having no objection to the limited prayer and if the claim of the petitioner is pending, it will be considered in accordance with law.

4. I have heard learned counsel for the parties and perused the material available on record.

Considering the facts and circumstances of the case instead of keeping this petition pending, I find it appropriate to dispose of the same at this stage directing the respondent-authorities to consider/decide the pending claim of the petitioner on its own merits as expeditiously as possible in accordance with law within a period of 45 days from the date of receipt of copy of this order.
6. With the aforesaid direction, the writ petition is disposed of. Sd/-
