GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the 2nd and 3rd respondents in not considering my representation/complaint for taking cognizance of my grievance and criminal attitude of the offenders where the petitioner, purchased property in Block N0.6/B, of Municipal D ward. Division No.48, Plot N0.I consists of 109.7 sq.yards of site with building. Plot No.2 vacant site which is an extent of 56.6 sq.yards within the limits of Eluru Mandal, Eluru corporation, Adivarapupeta, Eluru, West Godavari District which is attached in a Civil Suit vide O.S.No.40 of 2018 by suppressing the same the vendor with a fraudulent intention dishonestly sold the 2 subject property which is highly illegal, arbitrary, unjust, improper, contrary to rules and violation of Article 14 and 21 of the Constitution of India apart from violation of Principles of Natural Justice and consequently direct the 2nd and 3rd Respondents to take cognizance of the complaint submitted by the Petitioner 19.07.2025, 01.08.2025.” 2. Heard Sri E.Sesha Mahesh Babu, learned counsel for the petitioner and Sri Md.Farooq, learned Assistant Government Pleader for Home. 3. Learned Assistant Government Pleader for Home, on written instructions, would submit that the disputes between the parties are purely civil in nature. The husband of the petitioner had filed a complaint in the PGRS, upon which respondent No.3 conducted an enquiry and advised the petitioner's husband to approach the civil Court, as the matter is civil in nature. For which, the petitioner's husband accepted. 4. For ready reference, the written instructions are extracted hereunder: “This is purely civil matter. The petitioner’s husband namely Moggalla Srinivas filed a complaint in the PGRS. On that the respondent No.3 made enquires in to this and directed the petitioner’s husband namely Moggalla Srinivas to approach the Court as it is civil Matter and he gave his acceptance in this regard. It is respectfully submitted that, in compliance with the orders of the Honorable Court, appropriate steps will be taken to provide necessary police assistance to the petitioner as directed.” 5. Recording the said submissions, the Writ Petition is disposed of. There shall be no order as to costs.
