CMP Nos.23800 & 24656 of 2025
Both these applications, i.e. CMP No.23800 of 2025 has been filed by one Sh.Rajinder Singh, whereas, CMP No.24656 of 2025 has been filed by the Deputy Commissioner, Sirmaur for organizing receive/welcome the Palki of the Devta on 31.10.2025 in the school ground of Government Senior Secondary School, Dadahu, District Sirmaur, H.P.
It is averred that from time immemorial, the Palkis of Devtas/deities were welcomed/received in the school ground of Government Senior Secondary School, Dadahu and the ceremony will continue for 3-4 hours. 31.10.2025 is stated to be a local holiday, as per Annexure P-3, therefore, there will be no disturbance in the academic activities of the school.
In the application filed by the State, it has also been mentioned that on the earlier occasion, the meeting was held in Giri River, but there are crematoriums in Giri River and on account of such fact, the venue is sought to be shifted apparently on account of local sentiments.
Keeping in view the averments made in the applications, we allow both the applications, subject to the following conditions:- i) That the playground shall not be damaged and any garbage that is created [Sic generated] during the function, be got cleared by the concerned authorities;
ii) That no loss shall be caused to the property of the school and also the ground, where the function is proposed to be organized;
iii) That the order passed in CWPIL No.146 of 2017 shall be complied with strictly;
iv) That the school premises shall be kept neat and clean and no disturbance [Sic would be caused to the academic atmosphere of the school, and
v) That the law and order shall be maintained by the administration during the said period.
Keeping in view the above, the Deputy Commissioner, Sirmaur will deposit Rs.20,000/- in the School Welfare Fund.
Both the applications stand disposed of.
