SANDEEP MOUDGIL, J (ORAL) CRM-10744-2025 Prayer in this application is for placing on record the copy of affidavit/undertaking on behalf of the petitioner as Annexure P-5. Application is allowed, as prayed for. Annexure P-5 is taken on record with just exceptions. CRM-M-12674-2025 The instant petition under Section 482 BNSS, 2023, has been filed for grant of anticipatory bail to the petitioner in FIR No.05, dated 06.01.2025, under Sections 316(2), 318(4), 338, 336(3), 340(2), 61(2) of BNS, 2023 registered at Police Station Sector-7, District Panchkula (Annexure P-1). MEENU 2025.03.21 10:39 I attest to the accuracy and integrity of this document CRM-M-12674-2025 (O&M) -2- In compliance of the undertaking given by the petitioner, three demand drafts bearing Nos. 022992, 02293 and 022994 dated 17.03.2025 for an amount of Rs.25,00,000/- each which makes a total of Rs.75,00,000/-, have been handed over to the complainant, who is present in Court. Copies of the said demand drafts are taken on record. Learned Senior counsel appearing for the petitioner would refer to clause 5 of the affidavit/undertaking dated 11.03.2025 (Annexure P-5), whereby the petitioner namely Sangeeta Dua was undertaken that total 3.75 crores is payable out of which 75 lacs has been paid today by way of demand drafts. She undertakes to repay the balance amount in equal installment before 31.12.2025. In the light of above, learned counsel appearing for the complainant is not averse to the present petition by granting anticipatory bail to the petitioner. This Court vide order dated 11.03.2025, granted the concession of interim bail to the petitioner, subject to his joining the investigation. Learned counsel for the petitioner submits that in pursuance to the order dated 11.03.2025, the petitioner has joined the investigation. Learned State counsel does not controvert the said fact and on instructions further submits that custodial interrogation of the petitioner is not required. In view of the above, the order dated 11.03.2025 is made absolute. In case any undertaking given by the petitioner hereinabove including the terms reduced in writing in the affidavit dated 11.03.2025 as well as in para 4 of the instant application bearing CRM-10744-2025 is MEENU 2025.03.21 10:39 I attest to the accuracy and integrity of this document CRM-M-12674-2025 (O&M) -3- violated, this order shall automatically be deemed to have been cancelled.
