HON'BLE MR. JUSTICE PRAVEER BHATNAGAR
Order 06/02/2025
1. The instant bail application has been filed under Section 483 of B.N.S.S. on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No.651/2024, registered at Police Station Rajgarh (Alwar), District Alwar for the offence(s) under Sections 115(2), 126(2) and 352 of BNS.
2.
Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated for the offences under Sections 115(2), 126(2), 117(2) and 109(1) of BNS. It is contended that the complainant-party entered into the house of the accused-petitioner and thereafter caused injuries to the petitioner's father and the cross FIR was also lodged against the complainant-party and the Police has charge-sheeted persons of the complainant-party. It is also contended that injured Vishnu Lal has entered into the compromise with the accused-petitioner and scribed the compromise which bears his signature. The injured
[2025:RJ-JP:5394] (2 of 2) [CRLMB-475/2025] Vishnu Lal is also present before the Court, therefore, the bail application of the accused-petitioner may be allowed.
3. Learned Public Prosecutor has vehemently opposed the grant of bail application.
4.
Learned counsel appearing on behalf of the complainant concedes that the accused-petitioner and the injured Vishnu Lal have arrived at amicable settlement and executed the compromise deed, which bears signature of the accused-petitioner and the injured Vishnu Lal. It is also contended that injured Vishnu Lal is present before the Court and he has no objection if the accused- petitioner's bail application is allowed.
5. Heard and perused the material available on the record.
6. It is not desirable to express anything on the merits of the case and considering the fact that both the parties have arrived at amicable settlement and injured Vishnu Lal has scribed written compromise in favour of the accused-petitioner, I deem it just and proper to enlarge the accused-petitioner on bail.
7. Accordingly, the bail application under Section 483 of B.N.S.S. is allowed and it is ordered that the accused-petitioner- Manjeet S/o Pooran, in connection with FIR No.651/2024, registered at Police Station Rajgarh (Alwar), District Alwar, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
