THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA, SEEKING CERTAIN RELIEFS. THIS WRIT PETITION IS LISTED FOR PRELIMINARY HEARING IN 'B' GROUP, THIS DAY, AN ORDER IS MADE AS UNDER:
ORAL ORDER Sri.Sathisha.D.J., counsel for the petitioner and Smt.Girijamma.K.S., counsel for the respondents have appeared in person. 2. The short facts are these: It is said that the petitioner made an application on 25.04.2024 to the second respondent Authority seeking 1KW and 0 HP connection to his property. He also paid necessary charges. Taking note of the request made by the petitioner, the authority concerned sanctioned 1HP connection to the shed in the property. Despite the sanction of power connection, the second respondent did not provide power supply. Hence, the petitioner was constrained to make a representation on 01.06.2024 to the second respondent requesting to provide power supply. In response to the representation, the second

respondent without properly appreciating the representation, issued an endorsement and declined to provide power supply. Under these circumstances, the petitioner has filed the captioned Writ Petition. 3. Counsel for the respective parties urged several contentions. Heard the arguments and perused the Writ papers with care. 4. Suffice it to note that the authority concerned passed an order on 14.05.2024 and sanctioned power connection to the petitioner's shed. However, taking note of certain complaints, the authority concerned issued an endorsement on 21.06.2024 and rejected the representation made by the petitioner. The refusal to provide power supply is untenable. The reason is apparent.
As already noted above, permanent power connection was sanctioned to the petitioner on 14.05.2024. Hence, the authority concerned could not have refused to provide power supply. Hence, this Court deems it proper to quash the endorsement. - 4 -

5. The Writ of Certiorari is ordered. The Endorsement dated 21.06.2024 bearing PÀæ¸ÀA:¸ÀPÁE(«)/¸ÀE(vÁ)/¥À-6/PÀ-46/24- 25/656 issued by the second respondent vide Annexure-L is quashed. The Authority concerned is hereby directed to adhere to the power connection sanction order and provide power supply to the petitioner's shed. After the supply of the power, the petitioner shall pay the regular consumption charges without any default. 6. Resultantly, the Writ Petition is allowed.
