This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.129/2025 registered at Police Station Cyber Police Station Range, Raipur, Chhattisgarh for the offence punishable under Sections 317(2), 317(4), 317(5), 111(3) and 3(5) GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2025.07.15 10:44:55 +0530 2 of the BNS. 2. Case of the prosecution, in brief, is that a bank account held in the name of the applicant/accused with Bank of Maharashtra, Raipur branch, having IFSC Code MAHBOOO1928 and account number 60468670103, was registered with mobile number 7987674760 and had a balance of Rs.1,09,91,311/-. An online report was filed by Ravindra Manohar and two others regarding a cyber fraud transaction of Rs.7,000 on July 8, 2024, with Acknowledgment Number 31907240097719. The account statement for account number 60468670103, maintained in the name of the applicant/accused, was presented, covering the period from March 12, 2024, to February 2025. Upon review, it was observed that the account was credited and debited multiple times (average of 5-6 transactions per day) during this period, indicating unusual financial transactions. Consequently, a case was registered, and the applicant/accused was arrested. After investigation, a charge sheet was filed. 3. Learned counsel for the applicant submit that the applicant is innocent and she has been falsely implicated in the present case. He would submit that the police have fabricated a false case and she is not involved in the alleged offence and she is poor and supports her minor siblings through daily wages. He would further submit that charge sheet has been filed in this case, applicant is in jail since 27/03/2025 and conclusion of trial will take some time, therefore, he prays for grant of bail to the applicant. 3 4. On the other hand, learned State Counsel opposes the bail application. He would submit that charge sheet has been filed in this case before the competent court. He would submit that account number 60468670103 was opened by Vikaram Sahu in the name of the applicant in the Bank of Maharashtra, Raipur Branch and in between the period 12/03/2024 to 10/02/2025 amount of online fraud of Rs.1,09,91,311/- was credited in the account of applicant and as per the memorandum of applicant, she stated that she used to get Rs.2000/- per month as commission in lieu of the amount which was deposited in her account of online fraud. He would submit that the bail application of co-accused Sahil Jethwani has been rejected by this court in MCRC No. 4906 of 2025 on 26.06.2025, bail application of co- accused Ajay Sahu has been rejected by this Court in MCRC No. 3750 of 2025 on 27.06.2025 and bail application of co-accused Shivkumar Nirmalkar has been rejected by this Court in MCRC No. 4856 of 2025 on 25.06.2025. Hence the applicant is not entitled for grant of bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, nature and gravity of offence and the material available on record, considering the fact that present applicant was actively involved in commission of cyber fraud amounting to the tune of 4 Rs.1,09,91,311/- and it is an organized crime, also considering the fact that bail application of co-accused Sahil Jethwani has been rejected by this court in MCRC No. 4906 of 2025 on 26.06.2025, bail application of co-accused Ajay Sahu has been rejected by this Court in MCRC No. 3750 of 2025 on 27.06.2025 and bail application of co-accused Shivkumar Nirmalkar has been rejected by this Court in MCRC No. 4856 of 2025 on 25.06.2025, therefore, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of applicant Anjukumari involved in Crime No.129/2025 registered at Police Station Cyber Police Station Range, Raipur, Chhattisgarh for the offence punishable under Sections 317(2), 317(4), 317(5), 111(3) and 3(5) of the BNS., is rejected. 8.
