This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.02/2025 registered at Police Station – Pithora, District-Mahasamund (C.G.) under Sections 305(A), 331(4) and 3(5) of BNS.2023. 2. Case of the prosecution, in brief, is that the complainant Sarvan Kumar lodged report at police Station, Pithora to the effect that VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA
2 some unknown persons have stolen gold and silver ornaments from his house on 15.12.2024. On the basis of said report the offences were registered against unknown person and during course of investigation. 3. It has been argued by learned counsel for the applicant that the applicant has been falsely implicated in this case and no seizure has been made from the possession of the applicant. He further submits that only on the basis of memorandum statement of co- accused namely Alikumar, applicant has been implicated in this case. The applicant has 12 previous criminal antecedents and he is in jail since 01.01.2025 and the conclusion of the trial is likely to take quite long time. Therefore, he prays for grant of regular bail to the applicant. 4. On the other hand, learned counsel appearing for the State/non-applicant would oppose the bail application and submit that the charge-sheet has been filed in the present case before the competent Court and also endorse the said submission that the applicant has 12 previous criminal antecedent and he is resident of State of Madhya Pradesh therefore, the present applicant is not entitled for grant of bail. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6.
Taking into consideration the facts and circumstances of the case and considering the fact that applicant is having 12 previous criminal antecedent and he is resident of the State of Madhya Pradesh, as per memorandum statement of the co-
3 accused, present applicant was involved in the above offence, therefore, I am not inclined to grant regular bail to the present applicant. 7. Accordingly, the first bail application of the applicant– Guptaji Pardhi filed under Section 483 of Bhartiya Nagarik Suraksha Sanhita, 2023 involved in Crime No.02/2025 registered at Police Station – Pithora, District-Mahasamund (C.G.) under Sections 305(A), 331(4) and 3(5) of BNS, is rejected.
