1. Heard Mr. Shivendu Pandya, learned counsel for the petitioner. Also heard Mr. Hariom Rai, learned Panel Lawyer for the respondents/ State.
2. The petitioner has filed this petition praying for following relief:-
“I. That the Hon'le Court may kindly be pleased to call for the entire records pertaining to the Criminal Case No. 1259/2025 pending before the learned Judicial Magistrate First Class, Raipur, District Raipur (C.G.) for kind perusal of this Hon'ble Court. II. That, the Hon'ble Court may kindly be pleased to pass an order to quash the charge sheet against the present applicant for the offence punishable under section 498(A) of Indian Penal Code and the Criminal Case No. 1259/2025 pending before the learned Judicial Magistrate First Class, Raipur, District -Raipur (C.G.) in the interest of the Justice. III. Any other relief may also be granted to the applicants which this Hon'ble Court deems fit in facts and circumstances of the case.”
3. At the time of hearing, this Court has observed that the petitioner has filed the present petition without appropriate prayer which is defective one, therefore, we are not inclined to entertain the present petition with such a vague and sketchy prayer to which
learned counsel for the petitioner seeks permission of this Court to withdraw the present petition with liberty to file afresh with proper prayer.
4. Learned State counsel has no objection.

In view of the submissions made by learned counsel for the petitioner, the present petition is dismissed as withdrawn with the aforesaid liberty, as prayed for subject to depositing a sum of Rs. 2,000/- as cost by the petitioner in the Registry of this Court and the said amount shall be transmitted to the Government Multi- Disabled Home, Village Pendri, District- Janjgir- Champa (C.G.).
