Sinha, Advocate Mr. Chanchal Chhaya, Advocate For the State : Mr. Fahad Allam, AddI.P.P. …...... 08/22.08.2025: The petitioner is an accused for the offence punishable under Sections 17(b)/18(c)/ 22(b) of NDPS Act. 2. Heard, the learned counsel for the parties. 3. The bail of the petitioner was earlier rejected on merits. This is a case of recovery of 2.5 kg of opium, which is definitely a commercial quantity. 4. A report was called for about the status of N.D.P.S. Case No.59 of 2023, arising out of Sonahatu (Rahe) P.S. Case No.38 of 2023. The said repot dated 18.08.2025 of learned AJC-XII, Ranchi suggest that out of 7 chargesheet witness, 06 have already been examined in this case and only one is yet to be examined. It has been mentioned that this case can be concluded by end of October, 2025. 5. Considering the report and fact that the material which was recovered from the petitioner was of commercial quantity and at this stage this Court cannot give any certificate in terms of Section 37 of NDPS act and further considering that the trial is at the fag end and can be concluded within a period of two months, I am not inclined to grant privilege of bail to the petitioner. Accordingly, the prayer for bail of the petitioner in connection with N.D.P.S. Case No.59 of 2023 arising out of Sonahatu (Rahe) P.S. Case No.38 of 2023, pending in the Court of learned A.C.J.-II, Ranchi, stands rejected. (ANANDA SEN, J.) R.S./
