In view of the submissions made by learned counsel for the applicant-appellant and for the reasons mentioned in the application, the application for condonation of delay is allowed and the delay of 03 days which occurred in filing the restoration application, is condoned. 4. The present restoration application has been filed by the applicant-appellant for restoration of Civil Misc. Appeal No.440/2022 at its original number. 5. The Civil Misc. Appeal No.440/2022 was dismissed vide order dated 13.08.2024 in furtherance of peremptory order dated 12.09.2023 for want of submission of the required PF & notices. 6. Considered the submissions. 7. Having regard to the submissions made by counsel for the applicant-appellant and for the reasons mentioned in the restoration application, the same is allowed subject to payment of cost of Rs.500/- to be deposited with the Rajasthan High Court Munshi Sangh, Jaipur Bench, Jaipur. 8.
