GP FOR HOME The Court made the following: 3 The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “....to issue a Writ, order or direction, more particularly one in the nature of a Writ of Mandamus, declaring that the action of the respondents is illegal, arbitrary, and violative of Articles 14, 21 and 300-A of the Constitution of India, and consequently direct Respondent No.2 not to interfere in the civil matters pertaining to my house property measuring 118.20 square yards, bearing Door No:9-9-109/5, situated in Mangapuram Colony, Sivajipalem, Visakhapatnam and pass....” 2. Heard Sri Kanithi Deepak, learned counsel for the petitioner and Sri V.Farook, learned Assistant Government Pleader for Home. 3. Learned Assistant Government for Home, on written instructions, would submit that upon receipt of the complaint from the petitioner which is a civil dispute. The petitioner was advised to approach the Competent Civil Court. The petitioner was also advised to appear before the Pre-Litigation Counselling Forum (PLCF), established by Commissioner of Police, Visakhapatnam, for providing counselling to the parties involved in the civil disputes. It is also represented that O.S.No.1074 of 2021 is pending on the file of Principal District Judge Court, Visakhapatnam and A.S.Nos.29 and 30 of 2022 are also pending on the file of the Special Judge for SC and ST Cases, Visakhapatnam. Learned Assistant Government Pleader would further submit that police never interfere with the civil rights of the petitioner. 4. Recording the same, this writ petition is disposed of. However, the police are directed not to interfere in the civil disputes.
