PRAYING TO SET ASIDE THE JUDGMENT AND ORDER OF CONVICTION IN C.C.NO.28281/2009 DATED 18.05.2018 PASSED BY THE XXII ACMM, BANGALORE AND IN CRL.A.NO.1101/2018 DATED 12.10.2021 PASSED BY THE LXI ADDITIONAL CITY CIVIL AND SESSIONS JUDGE, BANGALORE (CCH- 62) FOR THE OFFENCE P/U/S 138 OF N.I ACT AND ALLOW THE AFORESAID REVISION PETITON. THIS PETITION COMING ON FOR CONCILIATION BEFORE NATIONAL LOK ADALAT, THE FOLLOWING CONCILIATION ORDER IS PASSED. CONCILIATION ORDER
Petitioner-accused and respondent-complainant are present duly identified by their respective counsel. 2. Heard the learned counsel appearing for the respective parties. 3. After prolonged negotiations, the matter is settled. The petitioner and the respondent along with their respective counsel have filed the joint memo, the petitioner-accused agreed to pay Rs.5,00,000/- as full and final settlement. The petitioner-accused has deposited a sum of Rs.5,00,000/- before the trial Court being the 50% of the fine amount, in that respondent-claimant has withdrawn Rs.1,00,000/-, remaining Rs.4,00,000/- is already deposited in trial Court and the petitioner-accused has no objection to release the full amount in favour of the respondent-complainant. 3
4. Both the parties have agreed to the terms of the joint memo and duly signed by them and their respective counsel. 5. The respondent-complainant is permitted to withdraw the amount in deposit of Rs.4,00,000/- on proper identification. 6. In view of the joint memo, the petition stands disposed of and the petitioner-accused is acquitted for the offence punishable under Section 138 of Negotiable Instruments Act, 1881. Sd/- JUDGE

The Counsel for the petitioner and respondent submits that both the parties have amicably settle the matter for an amount of Rs.5,00,000/- (Five Lakhs rupees only). The Petitioner has deposited amount of Rs.5,00,000/- (Five Lakhs rupees only) before the Trial Court. The respondent has withdrawn Rs.1,00,000/- (One Lakh rupees only). Remaining amount of Rs.4,00,000/- (Four Lakhs rupees) has been deposited on 14/03/2022 before the Trial Court and the petitioner has no objection to release the in favour of the respondent. The respondent prays to release the amount of Rs.4,00,000/- (Four Lakhs rupees only). Hence, the petitioner and the respondent has agreed for the full and final settlement. Therefore, the petitioner and the respondent prays this Hon’ble Court to dispose the matter as per the compromise of Joint Memo. The parties to this appeal have set their hands to this settlement before the Lok Adalat in the presence of Conciliators on this 26/04/2025 at Bengaluru Bench. Sd/-
