1. The instant CRMP has been filed under Section 528 of the Cr.P.C with following prayer:- I. First Information Report (FIR) bearing No. 11/2025 registered at Mahila Thana District Bilaspur Chhattisgarh on 20.10.2025 under Section 85, Section 296 and Section 3(5) of the Bhartiya Nyay Sanhita 2023, and consequential Charge Sheet bearing No. 35/2025 dated 2.05.2025 for offence punishable under Section 85, Section 296 and Section 3(5) of the Bhartiya Nyay Sanhita 2023; (Annexure P/1) II. The order dated 13.05.2025 passed by the learned Judicial Magistrate First Class, Bilaspur, Chhattisgarh taking cognizance of the aforementioned charge sheet along with all consequential orders arising therefrom; (Annexure P/5) III. The entire proceedings of Criminal Case No. 19977/2025 titled 'State of Chhattisgarh vs. Nikunj Khandwani and Others, pending before the Court of the learned Judicial Magistrate First Class, Bilaspur, Chhattisgarh. 3

Learned counsel for the petitioner submits that there being matrimonial dispute between petitioner No. 1 (Husband) and respondent No. 2 (wife), the matter has been amicably settled between the parties and MOU has been entered between the parties dated 08th April, 2025 before the trial court, Bilaspur. It is further submitted that mutual divorce application has been filed by the petitioner No. 1 and respondent No. 2 before the trial court. He further prays for quashment of the FIR and the charge sheet.
3. Learned counsel for respondent No. 2 submits, that matter has been amicably settled between the parties and he has no objection in quashment of FIR and charge sheet. 4. We have heard learned counsel for the parties and perused the documents. 5. In view of the above submissions made, as the matter has already been amicably settled between the parties, the present CRMP is allowed and consequently the FIR NO. 11/2025 registered at Mahila Thana, Bilaspur on 20.10.2025, the charge sheet bearing No. 35/2025 and the crime No. 19977/2025 and all consequential proceedings are hereby quashed.
