Ms. Manisha Rana Singh, Deputy Advocate General for the State. Hon’ble Ravindra Maithani, J. (Oral) Applicant Kuldeep Gangwar is in judicial custody in Criminal Case No. 8685 of 2024, State v. Kuldeep Gangwar, arising out of FIR No. 171 of 2024 dated 29.08.2024, P.S. Premnagar, District Dehradun. He has sought short term bail on the ground of his examination. 2. Heard learned counsel for the parties and perused the record. 3. A date sheet has been placed for perusal of the Court, according to which the examination is to take place on 5th, 6th and 8th March, 2025 from 10:00 a.m. to 01:00 p.m. at Ras Bihari Bose Subharti University, Dehradun. 4. Learned State Counsel, under instruction, would submit that the applicant is not eligible to take examination because of his short attendance and marks obtained. 2 5. Learned counsel for the applicant submits that the applicant may appear in the examination. 6. It becomes a little debatable. 7. Having considered, without adverting to the merits, purely on humanitarian ground, this Court is of the view that the applicant may be taken for his examination in police custody tomorrow i.e. 05.03.2025 so that he may be in the University at 09:30 a.m. If he is not permitted by the University authority to take examination, he will be taken back and thereafter he shall not be taken to the University for taking the examination. In case, the applicant is permitted to take examination, he may again be taken to the University on 6th and 8th March, 2025 at 09:30 a.m. 8.
