This Criminal Petition under Sections 480 and 483 of the BNSS is filed by the petitioner/A7 to grant regular bail in connection With Crime No.35 of 2024 of Koyyuru Police Station, Alluri Seetha Rama Raju District for the offences punishable under sections 8(c) read with 20(b)(ii)(C), of the NDPS AlcA. :I rr.- , i \\.S 2. Heard arguments of_Sri Kakumanu Joji Amrutha Raju, the learned I/ counsel for petitioner and Sri K. Sandeep, the learned Assistant Public Prosecutor for respondenVState. 3. Perused the record. 4. Having heard the learned counsel on both sides and perused the record, it is seen that on 31.03.2024, the petitioner/A7 along with other accused were found and from their possession 554 Kgs and 730 grams of ganja were recovered. They were subsequently remanded to judicial custody. The quantity recovered from the petitioner is a commercial quantity, hence presumption under Section 37 of NDPS Act applies. It is on that premise, learned Assistant Public Prosecutor opposed the prayer. 5. Recording all the reasons, this Court by an order dated 10.09.2024, granted bail to Accused 2, 4 and 5. The present application is filed by A-7 and he was remanded to judicl'al custody on 09.09.2024. A Reading of the Remand Report at once makes it clear that no part of contraband was recovered from the peti`tioner. Thus, the case of the prosecution rests on the confession of the accused and co-accused. Despite, lapse of four months, the Investigation Agency could not collect any further material indicating the complicity of this petitioner. Under the said circumstances, this Court is of the opinion that no further detention is necessary. Hence, the prayer is granted. -. 6. ln view of the said circumstances, the criminal petition is allowed. Petitioner herein/ A7, shall be enlarged on bail on executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each With two Jr, sureties of the like sum each to the satisfaction of the learned Metropol'ltan sessions Judge-Gum- Special Judge for Trial of offences under NDPS Act, visakhapatnam District. The petitioner 'IS Permitted tO furnish the Sureties from the state of Andhra Pradesh. Petitioner/ A7 shall mark his attendance before the Investigating officer on lst and 15th of every month between 10.00 A.M. and 1.00 P.M. till filing Of the Charge Sheet.
