Heard the parties
2. The petitioner has been made accused in connection with S.T. Case No. 38/2023 arising out of Herhanj P.S. Case No. 15/2019 corresponding to G.R. Case No. 661/2019(B), for the offences registered under Sections 302, 34 of the I.P.C. and Section 27 of the Arms Act, pending in the Court of learned Additional Sessions Judge-III, Latehar.
3. In the night of 31.05.2019, brother of the informant namely Jalandhar Paswan was shot dead by unknown persons.
4. It was submitted that complicity of the petitioner has come on the basis of confession of co-accused. It was further submitted that nothing incriminating has been recovered from the possession of the petitioner.
5. Mr. Shree Prakash Jha, learned A.P.P. has opposed the prayer for bail and submitted that the petitioner is a member of banned extremist organization and he has got criminal antecedent and 11 criminal cases pending against him.
6. Considering the submissions made above that apart from confession, there is no other material against the petitioner on the record, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is
directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-III, Latehar in connection with S.T. Case No. 38/2023 arising out of Herhanj P.S. Case No. 15/2019 corresponding to G.R. Case No. 661/2019(B).
