THIS CIVIL CONTEMPT PETITION IS COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE K.SOMASHEKAR and HON'BLE MR JUSTICE VENKATESH NAIK T ORAL ORDER (PER: HON'BLE MR JUSTICE K.SOMASHEKAR) This contempt proceedings has been initiated against the accused for disobeying the order dated 9-1-2023 passed in Writ Petition No.21681 of 2021 (S-RES), wherein the learned Single Judge disposed of the writ petition with liberty to the complainant/petitioner therein to file a representation with the Commissioner for Public Instructions within a period of three weeks' from that day and further directed the Commissioner for Public Instructions to consider such representation within a period of six weeks from the date of receipt of such representation. - 3 - NC: 2025:KHC:11431-DB CCC No. 877 of 2023 2. Smt. Shilpa Rani, learned counsel for the complainant, is physically present and submits that the accused has partially complied with the order. 3. Sri Harisha A.S., learned Additional Government Advocate appearing for accused Nos.1 and 3, presses into service for consideration of the additional counter affidavit dated 4-3-2025 filed by Smt. Girijamma, Block Education Officer, South Range-II, Tulasithota, Balepete, Bengaluru, consisting of paragraph Nos.1 to 4. 4. Paragraph Nos.2 and 3 reads as under: "2. I humbly submit that the Commissioner of School Education, Nrupathunga Road, Bengaluru, has already filed counter affidavit on 09.01.2024 with some particulars. The same may be read as part and parcel of this affidavit. I further submit that we have issued an endorsement dated 14.09.2023 to the complainant herein stating that all the dues have already been paid to Smt. Catherine and there are no balance to be paid from the Block Education Officer, South Range-II, Bengaluru, who is also Drawing Disbursing Officer. Copy of the endorsement dated 14.09.2023 is herewith produced and marked as Annexure-R8. - 4 - NC: 2025:KHC:11431-DB CCC No. 877 of 2023 3. I humbly submit that the calculations submitted by the complainant mentioned as Annexure-M before this Hon'ble Court is wrong. However, she is entitled for Rs.6,03,077/- only." 5. Additional compliance Affidavit dated 4-3-2025 is taken on record. The contents of the affidavit found to be acceptable and hence, no action is required to be taken against the accused. Accordingly, the contempt proceedings is hereby dropped. 6. At this stage, the learned counsel for the complainant seeks liberty to challenge the endorsement dated 14-9-2023.
