GP FOR REVENUE The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of 4th to 6th respondents in not registering the crime on 2nd and 3rd respondents proceedings dt. 16.07.2024 in Rc.No. 860/2018/Dt, Ric.No. 68/2024, 2 against the culprits/encroachers as illegal, irregular, irrational, amounts to non discharge of legal obligation conferred on 4th to 6th respondents under the provisions of Code of Bharatiya Nagarik Suraksha Sanhita 2023 and offends article 14 of Constitution of India and consequently direct the 4th to 6th respondents to register the crime and prosecute the accused persons for appropriate offences and penal provisions of law.” 2. Sri Md.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that the petitioner is not the concerned party with respect to the subject land, and that the entire land belongs to the Government. 3. For ready reference, the written instructions are extracted hereunder: “It is submitted that the respondent police are ready to give the assistant to the 2nd & 3rd respondents whenever they required, and further the petitioner is the not the concerned party to the subject land and the entire land is belongs to the Government, and the Revenue Officials taking suitable actions when every if any encroachments. Further recently there are no complaint or representation was received from the panchyat official or the revenue authorities, if any representation and complaint receives the SHO will take action in accordance of law, and further on oral enquiry the panchyat official has stated that the matter has been pending before the Hon’ble Court and they are not interfering to the matter till the proper adjudication of the case.” 4. Recording the said submissions, the Writ Petition is disposed of. There shall be no order as to costs.
