This application has been filed for condonation of delay of 70 days in filing the appeal on behalf of the appellant against the impugned judgement and decree.
Learned counsel for the respondent though has opposed the prayer for condonation of delay on the ground that day to day delay, as required to be explained under law, has not been explained and a vested right has been accrued in favour of the respondent for not filing the appeal within limitation period, but learned counsel for the applicant has reiterated the prayer for condonation of delay on the basis of the averments made in the application.
Considering rival contentions of the parties and the material before us, delay of 70 days is condoned. The application stands disposed of.

At this stage, learned counsel for the parties submit that it would be appropriate to refer the matter for mediation to explore possibility of an amicable settlement, if any.
In view of above, the matter is referred to Mr. Parveen Chandel, Advocate, for mediation with direction to the parties to appear before the learned Mediator on the date to be fixed by him with consultation of the parties through their counsel and on all subsequent dates as and when directed to do so and also render active cooperation for effective mediation.
