THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE SACHIN SHANKAR MAGADUM ORAL ORDER This petition is filed seeking direction against the Tahsildar to decide the application filed by the petitioner in Form No.53 seeking regularization of this unauthorized occupation in Sy No.62 measuring 3 acres 20 guntas. 2. Learned Additional Government Advocate submits that no such applications are pending as on today. However, she would ensure this Court that if such application is pending and not disposed off, the Tahsildar will get the application scrutinized by securing spot inspection and all relevant documents relating to the land. In the event petitioner's application is found genuine and not disposed, the same will be placed before the Land Grant Committee for further course of action. - 3 - NC: 2025:KHC:3452 WP No. 20007 of 2023 3. Recording the assurance of the learned Additional Government Advocate, this Court passes the following: ORDER i) The writ petition is allowed. ii) Respondent - Tahsildar shall enquire into the pendency of the application filed tendered by the petitioner in Form No.53. If this application is already decided, an endorsement shall be issued forthwith within a period of two weeks from the date of receipt of copy of this order. iii) If the application tendered in Form No.53 is kept pending, then the Tahsildar is required to secure report by following the procedure contemplated under the Rules 3 of 108CC of Karnataka Land Revenue Rules, 1966. 4. After securing all details, the Tahsildar shall place the petitioner's application with all requisite documents before the committee for further course of action.
