The petitioner has been made accused in connection with Palkot P.S. Case No. 55 of 2023, corresponding with NDPS Case No.02 of 2024, for the offences registered under Sections 20(b)(ii)(C)/22(c) of NDPS Act, pending in the court of learned Additional Session Judge-III, Gumla. Bail application of the petitioner was earlier rejected by this Court in B.A. No.2035/2024 vide order dated 22.04.2024. On 25.11.2023, Palkot police at about 12:30 p.m. intercepted Swift Dzire car bearing registration No. JH-01ER-2992 and Scorpio bearing registration No. JH-01EY-5669 at a place near Rajputana Dhaba. Petitioner is said to be the driver of said Swift Dzire car bearing registration No. JH-01ER-2992. On search, 21.5 kgs of cannabis were recovered from the said vehicle. Learned counsel for the petitioner has submitted that other co-accused persons have been granted bail by the Coordinate Bench of this Court. Learned A.P.P on behalf of the State has opposed the prayer for bail and submitted that the commercial quantity of cannabis was recovered from the vehicle, which the petitioner was driving. In view of the aforesaid fact, I am not inclined to release the petitioner, on bail. Accordingly, the prayer for bail of the petitioner is hereby rejected. (Ambuj Nath, J.) BS/-
