The petitioner has filed this writ petition seeking following reliefs:- “10.1. This Hon'ble Court may kindly be pleased to call for the entire record pertaining to the case of petitioner from the office of respondent No.4 to 6 by issuing a writ of certiorari. 10.2. This Hon'ble Court be pleased to order the respondent No. 1, 3 to 6 commanding them to a plot area 1500 sq.feet situated in Sales Tax Employees Society, Khamhardih Shankar Nagar, Raipur (C.G.) by implementing the order of respondent No.2 by issuing a writ of mandamus within a reasonable time. 10.3. Cost of the petition be awarded to the petitioner against the respondent No. 1, 3 to 6. 10.4. Any appropriate writ, direction or order may also kindly be passed in favour of the petitioner, which this Hon'ble Court deems fit in the circumstances of the case.” 2. Learned counsel for the petitioner would submit that the petitioner is an employee of Bank of Baroda and a Member of Sales Tax Employees’ Housing Society. She applied for the plot admeasuring 1500 sq.ft. in that Society and made payment of Rs.23,051/- along with the registration charges, but the Office Bearers and Directors of the Society failed to register the sale deed in her favour. He would contend that later on the Society went under liquidation. He would submit that a 3 complaint was made before the Lok Ayog and the Society officials were found guilty. He would submit that petitioner may be permitted to make representation before the Registrar, Cooperative Societies for allotment of an alternate plot and in turn, the concerned authority may be directed to consider the claim of the petitioner with regard to allotment of alternate plot. 3. On the other hand, learned counsel for the State would submit that an inquiry was conducted and it was found that there is no alternate plot available for allotment. He would contend that if the petitioner makes representation before the Registrar Cooperative Societies, the same would be considered by the said authority strictly in accordance with law. 4. Heard learned counsel for the parties. 5. Taking into consideration the limited prayer made by learned counsel for the petitioner, this writ petition is disposed off reserving liberty in favour of the petitioner to make representation before the Registrar, Cooperative Societies and, in turn, the authority concerned is directed to consider the representation in an objective manner, preferably within a period of 120 days from the date of receipt of representation.
