DISTRICT AND SESSIONS JUDGE, BENGALURU RURAL DISTRICT, BENGALURU IN CRL.APPEAL NO.68/2022 AND THE JUDGMENT AND ORDER DATED 03.09.2022 PASSED IN C.C.NO.3181/2018 ON THE FILE OF CHIEF JUDICIAL MAGISTRATE, BENGALURU RURAL DISTRICT, BENGALURU, BY ALLOWING THE COMPLAINT AND CONVICTING THE ACCUSED.

ORAL ORDER The petitioner and respondent and their respective counsels are present.
2. A compromise petition is filed in the form of joint memo under Section 147 of N.I Act. Its contents reads as under:
1. The petitioner filed a set revision petition by challenging the order of the First Appellate Court in Criminal Appeal No.68/2022, which is disposed off.
2. Both parties in the above case have decided to settle this dispute, and the petitioner has agreed to pay the full amount of Rs.20 lakhs as per the trial court order, out of which Rs.10,00,000 (Ten Lakh) is being paid today through DD No.770338 (Canara Bank, Bagalagunte Branch).

3. That the petitioner has no objection to withdraw the amount of Rs.4,01,000/- (Four Lakh) deposited before the Trial Court on 01.02.2022.
4. That the petitioner will pay the rest of the amount of Rs.600,000/- (six lakh) within 40 days from the date of the order of this Hon'ble Court.
5. That both parties are agreed to all the conditions listed above without any coercion or pressure.
3. The terms and conditions of the compromise petition are legal and equitable. Placing the joint memo on record, the revision petition stand disposed of in terms thereof.
4. However, it is made clear that if the amount as agreed in the joint memo is not paid, the order of the trial Court, which is confirmed by the First Appellate Court stands restored automatically and the respondent/complainant is at liberty to proceed against the petitioner/accused in accordance with law.
5. If the entire amount as agreed in the joint memo is paid, fine amount imposed by the trial Court, which is confirmed by the First Appellate Court to the

extent of Rs.5,000/- towards defraying expenses of the State is hereby set aside.
6. Amount in deposit is permitted to be withdrawn by the complainant under due identification.
