Heard Mr. Tarun Kumar No.1, learned counsel appearing on behalf of the petitioner, Mr. Ashok Kr. Yadav, learned Sr.S.C.-I and Mr. Sudarshan Srivastava, learned counsel appearing for the opposite party no.3.
In this application the petitioner has prayed for initiating a contempt proceeding against the opposite parties for willful and deliberate violation of the order of this Court dated 11.04.2023 passed in W.P.(S) No.5276 of 2012.
It has been submitted at the outset by learned counsel for the petitioner that the ACP benefits have already been extended to the petitioner and so far as the DACP benefits are concerned, sanction has already been made by the concerned authority.
Learned Sr.S.C.-I as well as learned counsel appearing for the opposite party no.3 have stated that DACP was never the subject matter of W.P.(S) No.5276 of 2012 but the same has been sanctioned and it is expected that the same shall be paid to the petitioner within a reasonable time.
In view of the fact that the writ application which was preferred by the petitioner was confined only with respect to grant of ACP benefits and pursuant to the order dated 11.04.2023 passed in W.P.(S) No.5276 of 2012, the ACP benefits have already been extended to the

petitioner as admitted by the learned counsel for the petitioner, I am not inclined to proceed further in this contempt application which accordingly stands disposed of.
Petitioner is at liberty to approach the authority if any further grievance remains to be fulfilled.
