HON'BLE MR. JUSTICE PRAVEER BHATNAGAR
Order 15/01/2025
1. These instant bail applications have been filed under Section 483 of B.N.S.S. on behalf of accused-petitioners. The accused- petitioners have been arrested in connection with FIR
[2025:RJ-JP:2048] (2 of 3) [CRLMB-11825/2024] No.227/2024, registered at Police Station Mahaveer Nagar, District Kota City, for the offence(s) under Sections 302 and 34 of IPC.
2.
Learned counsel for the petitioners submits that the accused- petitioners have falsely been implicated in this case. It is argued that the entire investigation clearly shows that gun shot injury to the deceased Yashwant was fired by the other co-accused Uday. It is also argued that the eye-witness Ravi in his statement rendered under Sections 161 and 164 of Cr.P.C. clearly stated that he saw the homemade revolver in the hand of the accused Uday Shankar. It is contended that at the time of incident the accused-petitioners and the other co-accused were making reels and the co-accused Uday directed the deceased Yashwant to capture the video. It is also contended that the video was captured by the Police during the investigation and in the investigation also in that video, it is revealed that the other co-accused Uday fired at deceased Yashwant. The accused-petitioners are in custody since 03.05.2024 and the trial of the case may take considerable time, therefore, these bail applications of the accused-petitioners may be allowed. 3. Learned Public Prosecutor as well as learned counsel appearing on behalf of the complainant have vehemently opposed the grant of bail applications. 4. It is contended by learned counsel for the complainant that the accused-petitioners and the other co-accused hatched conspiracy and thereafter, murdered the deceased Yashwant. The statement of Ravi clearly shows that the deceased was present with the accused-petitioners and the other co-accused. It is argued that the accused-petitioners are habitual offender and
[2025:RJ-JP:2048] (3 of 3) [CRLMB-11825/2024] against them many criminal cases are registered, therefore, these bail applications of the accused-petitioners may be dismissed. 5. Heard and perused the material available on the record. 6. Considering the arguments advanced by learned counsel for the petitioners and considering the fact that direct evidence of causing death of the deceased Yashwant is against Uday, without expressing anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioners on bail. 7. Accordingly, these bail applications under Section 483 of B.N.S.S. are allowed and it is ordered that the accused-petitioners namely; Ajay Salvi S/o Vijay and 2.
Deepak Prajapati @ Laddu Shooter S/o Shri Mahaveer, in connection with FIR No.227/2024, registered at Police Station Mahaveer Nagar, District Kota City, shall be enlarged on bail provided both of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
