Response stands filed on behalf of respondent No.1, a perusal whereof reveals that on the basis of statements of eye witnesses, recorded during investigation, Abdul Ghani, petitioner No. 1/accused was not present on the spot at the time of occurrence and he was not involved in the incident. Therefore, he has been exonerated from the ambit of case. However, offences under Sections 451, 147, 323, 504 and 506 IPC, came to be established against rest of the petitioners/accused.
Mr. Rahoof Khan, Advocate has submitted that he has no objection if the investigating agency is allowed to file final report in the competent Court.
In view of the above, the present petition is disposed of with liberty to the investigating agency to file final report in the competent Court.
Disposed of, along with connected CM(s).
Interim direction, if any, shall vacated.
