ORDER: The present Writ Petition came to be filed under Article 226 of the Constitution of India seeking the following relief:-
“....to issue a writ of mandamus or any other appropriate writ or direction deciaring the action of the 4^ respondent in not considering the representation dated 04.02.2025 and appointing the petitioners as permanent fair price shop dealers for their respective shops bearing no.0228105 at Chelluru village and Bearing No.0281055 at Alkananda colony both situated in Vizianagaram town and Mandal as illegal, arbitrary and in violation of Art. 14, 19 & 21 of constitution of India and contrary to the provisions of Andhra Pradesh state Targeted public distribution system (control)
order apart from violation of principles of natural justice and consequently direct the 4^ respondent to appoint the petitioners as permanent fair price shop dealers for their respective fair price shops ....’’ The 1®' petitioner was initially appointed as temporary in-charge dealer
2. to the fair price shop bearing No.0228105 at Chelluru Village, Vizianagaram Town and Mandal under the SHG group by the 5'^ respondent vide proceedings dated 18.02.2022. Likewise, the 2^^ petitioner was appointed for shop No.0281055 at Alkananda Colony, Vizianagaram Town and Mandal vide proceedings dated 03.09.2021. Though both the petitioners are running the said fair price shops without there being any complaint from the cardholders or from the concerned authorities, the respondents, without considering the case of the petitioners for appointment on permanent basis, have issued a notification dated 02.07.2022 calling for appointment of fair price shop dealers on permanent basis in Vizianagaram Division. Questioning the said notification, the petitioners were constrained to file W.P.No.22754 of 2022 along with two others and the said writ petition was dismissed vide orders dated 28.07.2025 on the ground that the petitioners, being temporary dealers. do not have any vested right to challenge the impugned notification, but.
4 VS,J W.P.No.23012 of2025 however, the petitioners given liberty to apply for being appointed permanent dealers, if they are eligible, before the concerned were as authority.

The case of the petitioners is that, the petitioners have made representations to the respondents No.4 and 5 respondents No.4 and 5 to consider the on 04.02.2025, requesting the case of the petitioners for appointment of fair shop dealers on permanent basis. But, as no action has been initiated by the respondents, the petitioners filed the present writ petition.

In view of the fact that the representations made by the petitioners are pending before respondents No.4 and 5, instead of going into the merits of the case, this Court feels it appropriate to dispose of the writ the respondents No.4 and 5 to made by the petitioners on 04.02.2025 within the date of receipt of a copy of this order. petition by directing pass appropriate orders on the representations a period of four (4) weeks from
