Sireesha Rani Vallabhaneni,Standing Counsel For Municipalities The Court made the following: ORDER: The present Writ Petition came to be filed under Article 226 of the Constitution of India seeking the following relief:- “to issue order or direction more particularly one in the nature of writ of mandamus declaring the action of the 1st respondent in not taking action on the representation dated 10 12 2012 for deletion of my site from the area of public and semipublic place as alleged to have been fixed in the master plan of the 2nd respondent municipality as illegal arbitrary and consequently direct the respondents to give permission to the petitioner to construct the additional floors as per the plan and pass such order or orders …” 2. When the matter came up for hearing, learned Standing Counsel for Corporation has furnished a copy of the written instruction of Commissioner of Knadukur Municipality wherein it is stated that the Government have taken initiation to update the Master Plan under AMRUT scheme. In this regard the municipality has verified and updated the survey numbers of the Government lands, private lands and their land use as per present status on ground. In this Connection, the petitioner’s land in Sy.No.609/2B was also changed from public and semipublic to Commercial Use as per published draft Master Plan dated 28.10.2022 and the proposals are yet to be approved. After the approval of the draft master Plan, the office will take further necessary action in this matter. 3. As per the said instructions, it appears that the government has already initiated steps for change of land in Sy.No.609/2B from public and semipublic to Commercial use as per published draft Master Plan dated 28.10.2022, which was prepared in pursuance of the representation submitted by the petitioner. 4. in view of the fact that the proposals are yet to be approved, instead of keeping the writ petition pending, this court feels it appropriate to dispose of the writ petition directing the respondents to inform the petitioner as and when the land of the petitioner in Sy.No.609/2B is changed from public and semipublic to commercial use. 5. With the above direction, the Writ Petition is disposed of. No costs.
