Heard the parties.
The petitioner is apprehending his arrest in connection with Ranga P.S. Case No. 85 of 2022 for the offences registered under sections 175 and 379 of the Indian Penal Code, sections 21(A) and 21(6) of Mines and Minerals (Development and Regulation) Act, 1957, Rule 4/54 of Jharkhand Minor Minerals Concession Rules, 2004 and Rule 7/9 of Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2017, pending in the court of learned Additional Chief Judicial Magistrate, Rajmahal. Anticipatory bail application of the petitioner was earlier twice rejected by this Court. Petitioner is owner of the vehicle bearing registration No.BR01GH- 6732, which was seized by Ranga police on 02.09.2022, loaded with stone chips. It appears that petitioner had not complied with the notice issued under Section 41A Cr.P.C. It was submitted that vehicle of the petitioner has already released to him and similarly situated co-accused persons have been granted bail. Considering the aforesaid facts and circumstances of the case, no fresh ground is made out for re-consider for grant of anticipatory bail to the petitioner. Accordingly, his prayer for anticipatory bail stands rejected.
