Petitioner(s). Versus The State of Jharkhand … Opp. Party(s). ------ With A.B.A. No. 1645 of 2025 ------ Ghanshyam Yadav, son of late Chaturi Yadav, resident of village Moktamma, P.O and P.S and District- Chatra, Jharkhand. ..... Petitioner(s). Versus The State of Jharkhand … Opp. Party(s) -------- CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Lalit Yadav and Manish Yadav, Advocates. For the State: Mr. Anup Pawan Topno, A.P.P Mr. Rakesh Kr. Sinha, A.P.P …..... 06/03.07.2025: These anticipatory bail applications under Section(s) 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, have been preferred by the petitioners apprehending their arrest for offences registered under Section(s) 302/201/34 IPC in connection with Chatra Sadar P.S. Case No. 273/2020 (G.R. No. 88/2021), pending in the Court of learned CJM/SDJM, Chatra. Heard the parties at length and had gone through the documents, annexed along with this application. The counsel for the petitioners submits that there is no eye witness to the occurrence and only on the basis of suspicion, the petitioners have been made accused. Learned A.P.P opposes the bail and submits that there is sufficient material against the petitioners in the case diary. The postmortem report also suggests that 12 years old boy was murdered as there are multiple bruises over the neck with serious cut injuries and the death was caused due to asphyxia, resulting from strangulation. He further submits that the statement of the child witness has also been recorded, who stated that these petitioners have kidnapped the boy, whose dead body was found later on. Considering the submission of the learned A.P.P, this is not a fit case to grant anticipatory bail to the petitioners. Accordingly, these application filed for grant of anticipatory bail of the petitioners, above named, are dismissed. Anu/-C.P.-3 (ANANDA SEN, J.)
