After hearing learned counsel for the petitioner when this Court has shown its disinclination to cause interference in the impugned order, he, on instructions, seeks withdrawal of the petition with liberty to file application after recording of the evidence of the plaintiff. 2. Petition is dismissed as withdrawn with liberty as prayed. It is, however, clarified that the grant of liberty does not mean that the Court is bound to allow the application.
