Order on Board 08/07/2025
1.
Learned counsel for the petitioner submits that the petitioner is challenging the impugned order dated 06.11.2024 passed by the learned Revenue Board Chhattisgarh, Bilaspur (C.G.) in case of Harishankar Jaiswal Jaiswal Vs. State of Chhattisgarh through Collector and District Magistrate, Korba bearing registration No. RN/10/R-B-121/173/2024, whereby the petition filed by the Digitally signed by JYOTI JHA Date: 2025.07.09 14:04:59 +0530
2 petitioner against the order dated 15.07.2024 passed by the learned Commissioner, Bilaspur Division, Bilaspur (C.G.) in Case No. 178/B-121/2023-24 was not admitted for hearing on the ground that the Revenue Board has no authority to hear a case against any proceeding conducted under Revenue Book Circular and the instant case is filed against non-proceeding of land exchange under the Revenue Book Circular and as the only authority to hear the case is State Government, therefore, the petition was dismissed. The order impugned and the entire proceeding by which the land of the petitioner has not been exchanged by a government land, is not only bad, illegal, arbitrary, but it is against the provisions of law and also there is violation of principles of natural justice and Article 14 of the Constitution of India. Therefore the impugned order dated 06.11.2024 is liable to be quashed.
2.
Learned counsel for respondents opposed the submission made by the learned counsel for petitioner.
3. I have heard learned counsel for the parties and perused the material available on record.
4. On perusal of records it transpires the admitted fact that the Commissioner has rejected the appeal filed by the petitioner and against the order of Commissioner, there is provision to file revision before the State Government, however the petitioner has filed the revision before the Revenue Board Chhattisgarh instead of the State Government.
5. Looking to the above circumstances, this Court finds it appropriate
3 to dispose of the present writ petition with a direction to the petitioner to file revision before the State Government against the
order of the Commissioner within 15 days from today and in the event of filing of the application, the State Government shall decide the revision on its own merits and in accordance with law.
6. It is made clear that this Court has not observed anything on the merits of the case.
7. Accordingly, the present writ petition stands disposed of. Sd/- (Arvind Kumar Verma) Judge Jyoti
